Terms of service

The following terms and conditions (referred to as both the “Terms of Service” and the “Agreement”) apply to the Eyrée website and all other websites, mobile sites, services, applications, platforms, and tools where these Terms and Conditions appear or are linked (collectively, the “Site”).

Eyrée provides access to the Site and its services to you (the “Customer”) subject to this Agreement. By accessing or using the Site, you acknowledge and agree to be bound by these Terms of Service. If you do not agree to this Agreement, you are not permitted to use the Site.

1. Who we are

As used in this Agreement and throughout the Site, the terms “Eyrée,” “Site,” “we,” and related references refer to Smart Choice Commerce LLC, headquartered at 5830 E 2nd St, Ste 7000 #30852, Casper, 82609, Wyoming, USA. All content made available on the Site is the exclusive property of Smart Choice Commerce LLC.

2. Changes to this Agreement

Eyrée reserves the right, at any time, to modify or update the terms of this Agreement. Notice of such changes may be provided to the Customer by written communication to the most recent address supplied by the Customer, by email, by posting the updated Terms of Service on the Site, or by any other method reasonably calculated to provide notice. Eyrée also reserves the right to modify or update its Privacy & Security Statement using the same procedures. Your continued use of the Site following any modification or update constitutes your acceptance of the revised Terms of Service.

3. Age requirement

The Site is intended for use by individuals who are 13 years of age or older. If you are under the age of 18, you may access and use the Site only with the involvement and supervision of a parent or legal guardian.

4. Your account

You may be required to register with Eyrée to access certain services or areas of the Site. In connection with any such registration, we may, at our discretion, decline to grant the username you request. Your username and password are for your personal use only. If you use the Site, you are responsible for maintaining the confidentiality of your account credentials and for restricting access to your devices. You agree to accept full responsibility for all activities that occur under your account or password.

In addition to all other rights available to Eyrée, we reserve the right, in our sole discretion, to terminate your account, refuse service, or cancel orders at any time.

5. Governing law, dispute resolution, and jury trial waiver

THIS AGREEMENT SHALL BE GOVERNED BY AND INTERPRETED IN ACCORDANCE WITH THE LAWS OF THE STATE OF WYOMING, WITHOUT REGARD TO ITS CONFLICT‑OF‑LAW PRINCIPLES. BY ACCEPTING THIS AGREEMENT, THE CUSTOMER CONSENTS AND AGREES TO THE EXCLUSIVE JURISDICTION OF THE STATE AND FEDERAL COURTS LOCATED IN CASPER, WYOMING, PROVIDED THAT EYRÉE OR THE CUSTOMER MAY SEEK ENFORCEMENT OF A JUDGMENT OF SUCH COURTS IN ANY COURT OF COMPETENT JURISDICTION.

BOTH SMART CHOICE COMMERCE LLC AND THE CUSTOMER WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE USE OF THE SITE.

6. License and access

Eyrée grants you a limited, revocable, non‑exclusive license to access and make personal, noncommercial use of the Site and its content, but only to the extent that such use complies with this Agreement and all applicable laws.

This license does not permit:

any resale or commercial use of the Site or its content;
the collection or use of product listings, descriptions, or prices;
any derivative use of the Site or its content;
downloading, copying, or using the Site or its content for the benefit of any third party;
the use of data mining, robots, or similar data‑gathering or extraction tools.

All rights not expressly granted to you under this Agreement are reserved by Smart Choice Commerce LLC and its content providers.

You may not reproduce, duplicate, copy, sell, resell, visit, or otherwise exploit the Site or any portion of it for any commercial purpose without Eyrée’s express written consent.

You may not:

frame or use framing techniques to enclose any Eyrée trademark, logo, or proprietary information (including images, text, page layout, or form) without express written consent;
use any meta tags or other “hidden text” that uses Eyrée’s name or trademarks without express written consent;
misuse the Site in any manner.

You may use the Site only as permitted by law. The license granted to you by Eyrée automatically terminates if you fail to comply with this Agreement or any other applicable Site Terms of Service.

7. Purpose of sales

All sales of products by Eyrée are intended solely for personal use. Products may not be purchased for resale, distribution, or any other commercial purpose without the express prior written approval of Eyrée.

Eyrée reserves the right to limit purchase quantities to amounts consistent with normal retail consumer use.

8. Copyright

All Site content—including design, text, graphics, images, logos, buttons, icons, interfaces, audio and video clips, and the selection and arrangement of such materials—is the exclusive property of Eyrée, Eyrée Marketplace™ sellers, or their respective content providers, and is protected by U.S. and international copyright laws.

All software used on the Site is the property of Eyrée or its respective software suppliers and is protected by U.S. and international copyright laws and other applicable treaties.

The compilation of all content on the Site—meaning the collection, arrangement, and assembly of materials—is the exclusive property of Eyrée and is protected by U.S. and international copyright laws.

9. Trademarks

Graphics, logos, page headers, button icons, scripts, and service names included in or made available through the Site are trademarks or trade dress of Eyrée or its licensors. Eyrée’s trademarks and trade dress may not be used in connection with any product or service that is not Eyrée’s, nor in any manner likely to confuse customers.

All other trademarks not owned by Eyrée that appear on the Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Eyrée.

10. Privacy Policy

Eyrée protects customer information in accordance with our Privacy Policy posted on the Site. The Privacy Policy, as amended from time to time, is incorporated by reference and forms an integral part of this Agreement.

11. Colors, satisfaction policy, and returns

Eyrée makes every reasonable effort to display product colors on the Site as accurately as possible. However, the actual colors you see depend on multiple factors, including your device, monitor type, and display settings. For this reason, Eyrée does not guarantee that any color displayed on the Site will be perfectly accurate. If you are dissatisfied with your experience on the Site, you are encouraged to contact us.

If you are not satisfied with any products you purchase on the Site (including Eyrée Marketplace™ products), you may return them using any of the methods made available through the Site, in accordance with our Return Policy. Any refunds or credits due will be issued pursuant to that policy.

12. Disclaimer – Beauty Products

Eyrée offers products from a wide range of reputable cosmetic, fragrance, and personal care manufacturers. The use and selection of cosmetics, fragrances, and other health and beauty products (“Beauty Products”) require care to ensure that all manufacturer directions and warnings are properly observed. Customers should be aware that individuals may experience allergic or other reactions to such products.

Eyrée endeavors to provide accurate product labeling information; however, Eyrée is not the manufacturer of all Beauty Products sold on the Site. Customers are strongly advised to read and strictly follow all labels, packaging inserts, instructions, and manufacturer directions and warnings.

Any information or advice provided on the Site regarding Beauty Products—whether in product descriptions, interactive features, or other areas—may rely on information from third‑party manufacturers or licensed professionals. For any Beauty Product not manufactured by Eyrée, we will, upon request, make reasonable efforts to identify the manufacturer and provide the Customer with available contact information.

13. General Disclaimer – All Products

Eyrée does not represent or warrant that the information accessible through the Site is accurate, complete, or current, nor that any advice or any particular product will achieve any specific result. Price and availability information on the Site is subject to change without notice. Eyrée shall not be bound by any errors or omissions in posting product information or prices for any products or services offered on the Site.

All materials and information presented by Eyrée on the Site are provided for informational purposes only. Products promoted on the Site, including cosmetic and personal care products, are not intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease, and are not intended to affect the structure or any function of the human body. Reported results, if any, may vary among individuals. Customers should consult their own physician or healthcare practitioner regarding any suggestions or recommendations made on the Site.

In providing product information, Eyrée relies in part on descriptions furnished by manufacturers, wholesalers, and other third parties. If you believe any information is inaccurate, please contact us.

Eyrée cannot and does not represent or warrant that the Site or its servers will be error‑free, uninterrupted, free from unauthorized access (including hacking or denial‑of‑service attacks), or that the Site will otherwise meet your requirements.

THE SITE AND ALL INFORMATION, CONTENT, WRITTEN MATERIALS, AND SERVICES MADE AVAILABLE THROUGH THE SITE (COLLECTIVELY, THE “SITE CONTENTS”) ARE PROVIDED BY EYRÉE ON AN “AS IS,” “AS AVAILABLE” BASIS, WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND. THIS INCLUDES, WITHOUT LIMITATION, ANY EXPRESS WARRANTIES, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ANY WARRANTIES REGARDING THE COMPLETENESS OF THE SITE CONTENTS OR THAT EMAILS SENT FROM EYRÉE ARE FREE OF MALWARE OR OTHER HARMFUL COMPONENTS. THESE DISCLAIMERS APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW AND SHALL NOT BE CONSTRUED MORE BROADLY THAN SUCH LAW ALLOWS.

14. Eyrée Marketplace

Eyrée operates an online marketplace on the Site that allows third‑party sellers who are not affiliated with Eyrée (“Eyrée Marketplace Sellers”) to sell and ship their products (“Eyrée Marketplace Products”) directly to you through the Site. Products offered by Marketplace Sellers will be identified with an “Eyrée Marketplace” badge on the product page.

Eyrée processes payments for Eyrée Marketplace Products sold by Marketplace Sellers and handles all payment‑related disputes, refunds, credits, and adjustments.

When you place an order that includes an Eyrée Marketplace Product, you acknowledge that the Marketplace portion of your order will be fulfilled by the Marketplace Seller, not by Eyrée. The Marketplace Seller is solely responsible for processing, packaging, and shipping the Marketplace Product. If any issues arise regarding your Marketplace order, please contact Eyrée Customer Support.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EYRÉE DISCLAIMS ALL RESPONSIBILITY AND LIABILITY FOR ANY ACTIONS OF AN EYRÉE MARKETPLACE SELLER, ANY EYRÉE MARKETPLACE PRODUCT, ANY CLAIM RELATING TO A MARKETPLACE PRODUCT, ANY SUBCONTRACTOR OR EMPLOYEE OF A MARKETPLACE SELLER, OR ANY REPRESENTATIONS OR WARRANTIES MADE BY A MARKETPLACE SELLER.

15. Order Acceptance, Shipping Terms, and Refunds

The receipt of an email order confirmation does not constitute acceptance of an order or confirmation of an offer to sell. It also does not guarantee that a product or service is in stock or available at the price or terms listed on the Site or in any catalog or advertisement.

Eyrée reserves the right, without prior notice, to limit order quantities on any item and/or to refuse service to any customer for any reason, including but not limited to: limited product availability, inaccuracies or errors in product or pricing information, or issues identified as potential fraud.

Eyrée may limit the quantity of items purchased per person, per household, or per order. These restrictions may apply to orders placed using the same account, the same credit card, or the same billing and/or shipping address. Eyrée also reserves the right, at its sole discretion, to prohibit sales to dealers or resellers or to limit quantities sold to them. For purposes of this Agreement, reselling is defined as purchasing or intending to purchase any item from Eyrée for commercial resale to a third party.

For items sold by Eyrée, pricing cannot be confirmed until an order is placed. Despite our best efforts, some items may be mispriced. If the correct price of an item is higher than the stated price, Eyrée may, at its discretion, either contact you for instructions before shipping or cancel your order. If your order is canceled after your payment method has been charged, a credit will be issued to the applicable payment account.

Pricing on the Site may differ from prices available in physical stores or mobile applications. Pricing and availability for mobile users remain subject to confirmation at checkout.

Verification of order and customer information may be required before accepting any order. Eyrée is not obligated to fulfill any order and may refuse any order. Alternatively, Eyrée may accept an order and provide an estimated shipment time, in which case the order remains open until delivery.

Charges to your payment method will only be processed when a shipment is made. Shipping and handling charges may reflect estimated or average costs and may not correspond to the exact cost of the specific order. Same‑day delivery may be available in limited geographic areas; applicable taxes and delivery fees apply. Delivery fees do not include voluntary tips or gratuities for couriers.

For authorized returns of goods purchased from the Site, Eyrée is not obligated to refund shipping, handling, delivery, or gift‑wrap charges, except when the return is due to a defective product. In such cases, Eyrée may refund the amount owed either by crediting the original payment method or by mailing a check to the address associated with the order.

16. Risk of Loss

The risk of loss for, and title to, products purchased on the Site passes to the purchaser once the order is delivered to the carrier.

17. Online Conduct

Any conduct that, in Eyrée’s sole discretion, restricts or inhibits another person from using or enjoying the Site is prohibited. Customers agree to use the Site only for lawful purposes and in accordance with this prohibition.

Customers further agree not to post or transmit through the Site any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, racially, ethnically, or otherwise objectionable material of any kind, including—but not limited to—material that encourages conduct constituting a criminal offense, giving rise to civil liability, or otherwise violating any applicable local, state, national, or international law.

18. User Comments, Feedback, Posts, and Other Submissions

You may submit, post, or otherwise make available reviews, comments, feedback, suggestions, questions, photos, videos, and other content on or through the Site (collectively, “Comments”), provided that your Comments do not contain any Prohibited Content. “Prohibited Content” includes material that:

is threatening, defamatory, hateful, harassing, abusive, or obscene;
violates privacy or publicity rights;
is false, deceptive, or misleading;
infringes any intellectual property right (including patent, copyright, trademark, or trade secret);
contains viruses, malware, or harmful code;
includes commercial or political solicitation;
violates any local, state, or federal law or regulation;
impersonates another person or entity;
includes advertisements, pyramid schemes, or other “spam”;
is otherwise objectionable or non‑family‑friendly as determined by Eyrée in its sole discretion.

Although Eyrée cannot monitor all Comments, Eyrée reserves the right (but not the obligation), in its sole discretion, to remove or edit any Comment on the Site at any time and for any reason. You remain solely responsible for any Comments you submit, post, or otherwise make available, and you agree to indemnify Eyrée for all claims resulting from such Comments.

Eyrée has no obligation to:

maintain any Comment in confidence;
compensate any person for any Comment; or
respond to any Comment.

Eyrée does not claim ownership of your Comments. However, by submitting a Comment, you agree that Eyrée may use it for purposes related to providing the Site, associated products and services, and Eyrée’s business operations (including those of its successors and assigns). You grant Eyrée a royalty‑free, perpetual, irrevocable, worldwide, unlimited, nonexclusive, fully sublicensable license to use, reproduce, create derivative works from, modify, adapt, publish, edit, translate, distribute, perform, and display the Comment in any media now known or later developed. You also grant Eyrée the right to use your name and any identification information you provide in connection with the Comment.

You represent and warrant that:

you own or control all rights to the Comment;
use of the Comment will not violate this Agreement; and
the Comment will not cause injury to any person or entity.

Eyrée assumes no responsibility and accepts no liability for any Comment or other content posted by you or any third party.

19. Copyright Complaints

Eyrée respects the intellectual property rights of others. If you believe that your work has been copied on our Site in a manner that constitutes copyright infringement, please follow the instructions provided in our Notice and Procedure for Copyright Infringement Claims to contact us and report the alleged infringement.

20. Notice and Procedure for Copyright Infringement Claims

Eyrée’s policy is to respond promptly to claims of copyright infringement on the Site. If you believe that your work has been copied on the Site in a manner that constitutes copyright infringement under United States copyright law, you must submit a notification to Eyrée’s Copyright Agent (listed below).

Your notification must include all of the following:

The physical or electronic signature of a person authorized to act on behalf of the copyright owner;
A description of the copyrighted work(s) you claim has been infringed;
A description of the location on the Site of the material you claim is infringing;
Your address, telephone number, and email address;
A statement that you have a good‑faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
A statement, made under penalty of perjury, that the information in your notification is accurate and that you are authorized to act on behalf of the copyright owner.

Upon receiving a valid notification of alleged copyright infringement, Eyrée’s policy is to remove or disable access to the identified material, forward the written notification to the alleged infringer, and make reasonable efforts to notify them that the material has been removed or disabled.

If a copyright infringement notice has been filed against you, you may submit a counter‑notification to Eyrée’s Copyright Agent at the address listed above.

A valid counter‑notification must include:

Your physical or electronic signature;
A description of the material that was removed or disabled, and the location where it appeared before removal;
A statement, under penalty of perjury, that you have a good‑faith belief that the material was removed due to mistake or misidentification;
Your name, address, telephone number, and email address;
A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, and that you will accept service of process from the original complaining party.

If a counter‑notification is received, Eyrée may send a copy to the original complainant, informing them that the removed content may be restored in 10 business days. Unless the copyright owner files a court action seeking to prevent restoration, the removed content may be reinstated 10–14 business days after receipt of the counter‑notification, at Eyrée’s sole discretion.

21. Termination of Usage

Eyrée may, without incurring any liability to the Customer, terminate or suspend a Customer’s access to all or any part of the Site, without notice, for any conduct that Eyrée, in its sole discretion, believes violates any applicable law or this Agreement, or is harmful to the interests of another user, a third party, a merchant, a sponsor, a licensor, a service provider, or Eyrée.

22. Outside Sites and Linking

The Site may contain links to other websites on the Internet that are owned or operated by third‑party vendors or other independent parties (“Outside Sites”). Eyrée is not responsible for the availability of any Outside Site, nor for the content found on or through such sites. If you have concerns regarding any link or the content of an Outside Site, you should contact the administrator or webmaster of that site directly.

Eyrée permits certain third‑party links to the home page of the Site, provided that Eyrée is notified of such links and does not subsequently object to them. No links or “deep links” to any page other than the Site’s home page are permitted without Eyrée’s prior written consent. Eyrée reserves the unilateral right to revoke any linking permission at any time, including permission to link to the home page.

23. SMS Terms and Conditions

By texting Eyrée from your mobile device, you agree to receive recurring messages from Eyrée. Consent to receive SMS messages is not a condition of purchase.

You may reply STOP to cancel or HELP for assistance. Standard message and data rates may apply. Mobile carriers are not responsible for delayed or undelivered messages.

If you opt in to text communications for same‑day delivery, you may also receive messages from Eyrée or its service providers regarding your order.

24. Mobile Service, Internet, and Service Fees

This section applies to users of Eyrée’s mobile application (the “Application”). Use of the Application requires a compatible mobile device and a wireless data service provided by your mobile carrier, and may also require Internet access from your service provider. You are solely responsible for obtaining these services and devices, and for paying all associated costs, including any usage charges.

You may be required to send and receive electronic communications related to the Application—such as administrative messages, service announcements, diagnostic reports, and Application updates—from Eyrée, your mobile carrier, or third‑party service providers. If you do not have an unlimited data plan, your carrier may charge additional fees for data usage associated with the Application.

You are solely responsible for obtaining any additional subscriptions, connectivity services, or equipment necessary to access the Application, including all third‑party fees for information sent to or through the Application.

The Application may not function on all devices or with all mobile carriers. Eyrée makes no representations that the Application will be compatible with, or supported by, every carrier or device. If fees are charged for the Application or if third‑party service providers charge fees for products or services they offer, you agree to pay those fees to the respective parties as a condition of continued use. Certain services may be subject to additional or different terms (including fees), which you must agree to before using those services.

25. Eyrée Community

The Eyrée Community (“Community”) is an online social space available through Eyrée’s website and mobile application, allowing members to interact with one another, share content, and further explore the Eyrée brand. You must be at least 16 years old to participate. If you are between 16 and 18 (or the age of consent where you live), you must obtain permission from a parent or legal guardian before accepting this Agreement or participating in the Community.

To join the Community, you must register for an Eyrée account. The Community is operated and managed by a third‑party service provider. To learn more about this provider, including how it processes your personal information, you may contact us at our designated legal email address. By participating in the Community, you acknowledge and agree that Eyrée may share your information with this third‑party service provider for purposes related to operating the Community.

For details on how Eyrée handles personal information submitted through the Community, please refer to our Privacy Policy. Once you become a Community member, certain information associated with your profile and any content you post may be visible to other users. If you wish to make your profile private, you may delete your Community profile.

All Community members must comply with the Eyrée Community Guidelines. Eyrée reserves the right, at its sole discretion, to remove any Community member who violates these guidelines or this Agreement at any time.

26. Severability

If any provision of this Agreement is determined to be contrary to law, the remainder of that provision (if any), as well as all other provisions of this Agreement, will continue in full force and effect.

27. Waiver

A waiver of any breach or default under this Agreement does not constitute a waiver of any subsequent breach or default, nor does it amend or diminish the rights of the party granting the waiver.

28. Entire Agreement

This Agreement, as amended from time to time, constitutes the complete and exclusive agreement between Eyrée and the Customer regarding the subject matter addressed herein. It supersedes and replaces all prior discussions, negotiations, understandings, and agreements—whether written or oral—relating to such matters.

Any additional or different terms contained in a purchase order or in any other written or oral communication from the Customer are deemed rejected by Eyrée without the need for further notice and shall not form part of this Agreement nor be binding upon Eyrée in any way.

29. Acceptance of This Agreement and of Amendments and Modifications Thereof

Use of the Site constitutes the Customer’s acceptance of the terms of this Agreement. The Site is governed solely by the terms of this Agreement—as amended from time to time—and by the policies published by Eyrée on the Site, which together form the entire agreement between the parties regarding use of the Site.

Eyrée may amend or modify this Agreement at any time by sending an email to the Customer at the Customer’s last known email address or by posting the updated Agreement on the Site.
